The proper language is "The following are not excluded by the rule against hearsay, regardless of whether the declarant is available as a witness." Egregious error.

Great tool
Needed this to do the rules of evidence in the court. I do my own court paper, can't afford an attorney.
FRE comes with advisory notes, which can be helpful to analyze the rules, certain applications and restrictions, as well congressional intent.
Its good book as Evidence book.
